Family-Based Residence

Whether you want to bring your wife and children or your parents and brothers to the United States as permanent residents we can help you the process of petitioning for them.

Depending on what family member it is and how old your or them are (and sometimes your nationality – Mexico, Philippines, India), the process will vary in time.  Also the immigration of a family member will be affected by if they are in their home country now or if they are in the United States.  How they came to the United States is another factor that has to be taken into account when you are dealing with the residence process of your family.  Who can you petition:

US Citizens:

  1. Spouse: Wife or Husband (Same sex marriages are accepted since 2016).
  2. Children: Under 21 years old.
  3. Sons -Daughters: Over 21 married or single.
  4. Parents: If the Citizen is over 21.
  5. Siblings: Brothers and Sister of US Citizens.

Permanent Residents:

  1. Spouse: Wife or Husband (Same sex marriages are accepted since 2016).
  2. Children: Under 21 years old.
  3. Sons -Daughters: Over 21 only if single (No brothers or children over 21 who are married).

The time these processes will take depends on something called the VISA BULLETIN which is published by the Department of State.  Please find a link here.  If you need assistance with reuniting your family or getting their immigration status resolved in the United States give us a call to see how we can help you.

If it is an immigration emergency (you or a family member is detained or is about to be deported please text us at any time here).

Remember you and your family have rights, but so do all government officials – being polite and courteous will take you a long way in letting ice officers know you want to have a lawyer present for any interrogation.
